By accessing https://levitationtechhq.com, purchasing our services, or submitting a creative project, you agree to these Terms of Service.
1. Our Services
Levitation Tech provides professional creative and advertising services, including:
- AI-generated and real-human video production
- Custom promotional graphics and advertising materials
- UGC and affiliate marketing creatives
- Social media and e-commerce advertising content
- Brand campaigns and promotional media
- Custom creative packages and monthly creative retainers
Services are delivered digitally unless otherwise agreed in writing.
2. Orders and Creative Packages
Customers may purchase individual creative services, multi-piece packages, or recurring monthly retainers.
Each purchase includes the deliverables and limitations described in the applicable product listing at the time of purchase.
A creative piece may consist of an eligible video, graphic, or other agreed digital deliverable, subject to the purchased package.
Video duration limits, number of creative pieces, included revisions, and other specifications are determined by the purchased package or written project agreement.
Requests outside the purchased scope may require additional payment.
3. Creative Production Process
Customers are responsible for providing accurate instructions, project objectives, reference materials, branding assets, and other information reasonably required to complete their projects.
Production schedules begin once payment has been received and the necessary project information and materials have been provided.
Levitation Tech may request clarification or additional materials before beginning production.
Changes to the approved project scope may affect pricing and delivery timelines.
4. AI and Real-Human Creative Content
Levitation Tech may use artificial intelligence, professional creative software, human talent, or a combination of production methods.
Customers acknowledge that AI-generated content may contain visual or technical imperfections and that exact replication of reference materials cannot always be guaranteed.
Real-human talent, specialized filming, licensed assets, and other premium production requirements may involve additional charges. Such charges will be disclosed for customer approval before being incurred.
Levitation Tech will make reasonable efforts to deliver professional creative materials consistent with the agreed project requirements.
5. Pricing and Payments
Prices are displayed in U.S. dollars unless otherwise stated.
Payment is required before production begins unless a separate written agreement provides otherwise.
Additional services, revisions, or production expenses outside the purchased package require customer approval before additional charges are incurred.
Levitation Tech reserves the right to change prices for future purchases. Price changes do not retroactively affect completed purchases or an applicable active promotional rate guarantee.
6. Monthly Creative Retainer
The 10-Piece Micro Retainer provides up to 10 eligible creative pieces during each paid monthly billing cycle.
All unused creative pieces expire at the end of the applicable billing cycle.
Unused pieces do not roll over, accumulate, convert into credits, or transfer to subsequent months.
Customers must submit complete project requests and required materials within the agreed submission deadlines.
If Levitation Tech is unable to fulfill an eligible request submitted within the agreed deadline, an appropriate remedy will be arranged. This may include completing outstanding work after the billing cycle, providing a credit, or issuing a refund where appropriate.
Subscription Billing
Monthly subscriptions automatically renew and are charged according to the billing terms disclosed at checkout.
Customers authorize recurring charges when enrolling in a subscription.
Customers may cancel future renewals through the available subscription management process or by contacting Levitation Tech before the next scheduled billing date.
Cancellation prevents future renewals but does not automatically refund services already performed.
Promotional Price Lock
Customers who subscribe at an eligible promotional locked-in rate may retain that rate while their subscription remains continuously active and payments remain current.
Cancellation or termination ends the promotional price guarantee. Re-enrollment may be subject to then-current pricing.
7. Revisions and Creative Changes
Revision allowances are determined by the purchased package or written project agreement.
Corrections addressing technical defects, missing agreed elements, or material discrepancies from the approved project brief will be reviewed and addressed as appropriate.
Additional concepts, substantial changes in direction, or requests outside the agreed scope may incur additional charges.
8. Digital Delivery
Completed creative projects are delivered electronically through a method communicated by Levitation Tech.
Delivery timelines are estimates unless expressly agreed otherwise in writing.
Delays caused by incomplete client information, late approvals, additional requests, or circumstances outside our reasonable control may affect delivery schedules.
9. Intellectual Property and Usage Rights
Customers retain ownership of original materials, trademarks, logos, photographs, and other content they lawfully provide.
Upon full payment, customers receive the rights necessary to use the final approved deliverables for the commercial or personal purposes agreed upon for the project, subject to any disclosed third-party licensing restrictions.
Unless expressly agreed otherwise in writing, editable source files, unused concepts, preliminary drafts, proprietary workflows, and underlying production materials are not included in the purchase.
Third-party music, fonts, stock assets, software-generated elements, and other licensed materials remain subject to their applicable licenses.
AI-generated elements may not qualify for exclusive copyright protection under applicable law. Levitation Tech does not guarantee that every AI-generated element is unique or independently copyrightable.
Levitation Tech will not knowingly grant rights that it does not possess.
10. Customer Materials and Permissions
Customers represent that they have the necessary rights and permissions to submit and authorize the use of their materials.
Customers must not request content that unlawfully infringes intellectual property rights, violates privacy or publicity rights, impersonates individuals without appropriate authorization, or otherwise violates applicable law.
Levitation Tech may decline or discontinue projects involving unlawful, deceptive, or otherwise prohibited content.
Where services are discontinued, any refund will be determined based on work performed, nonrecoverable expenses, the Return, Refund & Cancellation Policy, and applicable law.
11. Advertising and Marketing Results
Levitation Tech provides creative production services, not guaranteed advertising outcomes.
We do not guarantee specific sales, revenue, engagement, followers, conversions, advertising approvals, or campaign performance.
Customers are responsible for reviewing their advertising claims and ensuring that published materials comply with applicable laws and platform requirements.
12. Portfolio and Confidentiality
Levitation Tech will respect confidential customer information and will not intentionally disclose nonpublic project materials except as necessary to provide services, as authorized by the customer, or as legally required.
Levitation Tech will obtain customer permission before publicly featuring commissioned deliverables in its portfolio, promotional materials, or social media, unless the customer has separately agreed to such use.
13. Refunds and Cancellations
Refunds, cancellations, and project corrections are governed by our published Return, Refund & Cancellation Policy and applicable law.
Customers should review that policy before purchasing.
14. Service Availability and Limitations
Levitation Tech strives to provide reliable, professional services but cannot guarantee uninterrupted website access or error-free operation of third-party creative platforms.
To the extent permitted by applicable law, Levitation Tech is not responsible for indirect or consequential losses arising from the use of its services.
Nothing in these Terms excludes liability or legal remedies that cannot lawfully be excluded.
15. Changes to These Terms
Levitation Tech may update these Terms of Service periodically.
Updated terms will be published on our website and will apply prospectively, except where otherwise permitted by law.
Existing purchases remain subject to the terms applicable at the time of purchase unless the parties agree otherwise or applicable law requires a change.
16. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, subject to any mandatory consumer protections or other applicable legal requirements.
